Terms of Service

These Terms of Service (“Terms”) govern your access to and use of DUXME (“Service”), operated by the individuals behind the DUXME project (“we”, “us”). By creating an account or using the Service, you agree to these Terms.
If you do not agree, do not use the Service. We may update these Terms; the date at the top will change when we do. Continued use after changes means you accept the updated Terms.
1. Eligibility and the Service
You must be able to form a binding contract under applicable law to use the Service. The Service lets you create, edit, and share travel guides and maps, including adding places, categories, and descriptions.
2. Accounts and security
You are responsible for activity under your account and for keeping your credentials confidential. Notify us promptly at the contact below if you suspect unauthorized access.
3. Your content
You retain ownership of content you submit (“User Content”). You grant us a worldwide, non-exclusive, royalty-free licence to host, store, reproduce, display, and distribute User Content solely to operate, improve, and provide the Service (including sharing maps according to your settings).
You represent that you have the rights needed to grant the above licence and that your User Content does not violate law or third-party rights.
4. Acceptable use
- Do not use the Service unlawfully, to harm others, or to distribute malware or spam.
- Do not attempt to gain unauthorized access to the Service, other accounts, or our systems.
- Do not scrape or overload the Service in a way that impairs it for others.
- Do not use the Service to infringe intellectual property or privacy rights.
5. Google Maps and related features
Parts of the Service use Google Maps Platform and related APIs (e.g. search, place details, import from Google Maps data). Your use of those features is also subject to Google’s applicable terms and policies. We do not control Google’s services.
6. Paid features and Polar
Some features may be paid. Payments are processed by Polar (polar.sh) or its successors as our payment partner. Fees, billing cycles, and taxes are shown at checkout or in your account where applicable.
Except where required by law, fees are generally non-refundable. Subscription terms (if any) will be described at purchase. Chargebacks or payment disputes may result in suspension of access until resolved.
7. Newsletter and communications
If you opt in to marketing or product emails, we may send you messages about the Service. You can unsubscribe using the link in those emails or by contacting us.
8. Our intellectual property
The Service, its branding, and our software (excluding your User Content) are owned by us or our licensors. Except for the limited rights these Terms grant, no rights are transferred to you.
9. Availability and changes
We aim to keep the Service available but do not guarantee uninterrupted or error-free operation. We may modify, suspend, or discontinue features or the Service with reasonable notice where practicable.
10. Termination
You may stop using the Service at any time. We may suspend or terminate access if you materially breach these Terms, if we must do so for legal or security reasons, or if we wind down the Service.
Upon termination, your right to use the Service ends. Provisions that by nature should survive (e.g. liability limits, governing law) will survive.
11. Disclaimers
The Service is provided “as is” and “as available” to the fullest extent permitted by law. We disclaim implied warranties such as merchantability, fitness for a particular purpose, and non-infringement where allowed.
12. Limitation of liability
To the fullest extent permitted by law, we are not liable for indirect, incidental, special, consequential, or punitive damages, or loss of profits, data, or goodwill, arising from your use of the Service.
Our aggregate liability for claims arising from the Service is limited to the greater of (a) the amount you paid us for the Service in the twelve months before the claim or (b) fifty euros (€50), except where liability cannot be limited by law.
13. Indemnity
You will defend and indemnify us against third-party claims arising from your User Content or your misuse of the Service, to the extent permitted by law.
14. Governing law and disputes
These Terms are governed by the laws of Poland, without regard to conflict-of-law rules. Courts in Poland have exclusive jurisdiction, subject to mandatory consumer protections in your country of residence where they apply.
15. General
- These Terms are the entire agreement between you and us regarding the Service.
- If a provision is unenforceable, the remainder stays in effect.
- We may assign these Terms in connection with a merger or sale; you may not assign without our consent.
